These Terms govern your use of the Rouxbarb mobile app and website (the “Services”), operated by Rouxbarb (“we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms. If you don't agree, don't use the Services.
1. Eligibility
You must be at least 13 years old (or 16 if you are in the EU/UK) to use Rouxbarb. By using the Services, you represent that you meet this requirement and have the legal capacity to enter these Terms. [TODO: verify age threshold for launch jurisdictions]
2. Your Account
You sign in to Rouxbarb using your Google or Apple account, or via a sign-in link sent to your email. You're responsible for the activity on your account and for keeping your sign-in credentials secure. Notify us immediately at support@rouxbarb.com if you suspect unauthorized use.
3. User Content
3.1 Ownership
You retain ownership of the recipes, photos, videos, comments, and other content you create or upload (“User Content”).
3.2 License you grant Rouxbarb
By submitting User Content, you grant Rouxbarb a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing or encoding), distribute, publicly display, and create derivative works of your User Content for the purpose of operating, promoting, and improving the Services. This license ends when you delete the relevant User Content, except for backups and cached copies that take time to expire.
3.3 Your responsibilities
You confirm that:
- You own or have permission to share all User Content you upload
- Your User Content does not infringe anyone's rights and complies with applicable law
- Recipes, photos, and videos you mark as your original work are, in fact, yours
4. Prohibited Conduct
You may not:
- Post content that is illegal, infringing, defamatory, hateful, sexually explicit, or violent
- Impersonate others, misrepresent your affiliation, or create fake accounts
- Scrape, mass-download, or reverse-engineer the Services
- Disrupt or attempt to compromise the security of the Services
- Use the Services to send spam or unsolicited communications
- Circumvent paywalls, content protections, or usage limits
We may remove content, suspend accounts, or take other action for violations of these Terms or our community guidelines.
5. Premium Subscriptions and Purchases
Rouxbarb offers paid features including Premium Creator subscriptions, Devour Coin (DC) packs, and individual recipe unlocks. Purchases on iOS are processed by Apple; Apple's terms and refund policies apply. Creator payouts are processed via Stripe.
Subscriptions auto-renew until cancelled. You can manage subscriptions in your device's account settings.
6. Creator Earnings and Payouts
Creators who enable monetization receive a share of revenue from paid recipe unlocks, tips, and subscriptions, less platform fees and payment processor fees. [TODO: insert specific revenue-share percentages and payout terms] Creators are responsible for any taxes owed on their earnings.
7. Intellectual Property
The Rouxbarb name, logo, and Services (excluding User Content) are owned by Rouxbarb and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes (and, if monetization is enabled, to publish content you own).
8. Termination
You can delete your account at any time from the app. We may suspend or terminate your account if you violate these Terms, create risk for the platform or other users, or for other legitimate business reasons. On termination, your access to the Services ends, but Sections 3.2 (license to existing User Content), 4 (prohibited conduct), 9 (disclaimers), 10 (limitation of liability), and 11 (governing law) survive.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind. Recipes and cooking instructions posted by users are not professionally tested by Rouxbarb. You are responsible for evaluating ingredients (including allergens) and following safe cooking practices. We are not liable for outcomes arising from User Content.
10. Limitation of Liability
To the maximum extent permitted by law, Rouxbarb is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services. Our total liability for any claim is limited to the greater of $100 USD or the amount you paid us in the twelve months before the claim.
11. Governing Law
These Terms are governed by the laws of [TODO: jurisdiction — Denmark? Delaware? choose based on entity], without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction.
12. Changes to These Terms
