These Beta Participation Terms ("Terms") apply to your participation in the Rouxbarb closed beta program (the "Beta"). The Beta is operated by Rouxbarb ApS, CVR no. 46028244, Njalsgade 21F, 2300 København S, Denmark ("Rouxbarb", "we", "us", or "our"). By accepting a TestFlight invitation or otherwise participating in the Beta, you agree to these Terms in full.
1. Who may participate
The Beta is invitation-only. Invitations are issued at our sole discretion following review of your application. Participation is personal to you and may not be transferred to any other person. We may revoke your access at any time, for any reason, without notice or liability.
2. Nature of the Beta
The Rouxbarb application made available through the Beta (the "Beta App") is a pre-release, work-in-progress product. It is provided strictly for testing and evaluation purposes.
The Beta App is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory. We make no guarantee that the Beta App will be error-free, uninterrupted, fit for any particular purpose, or free from data loss. You use it at your own risk.
Your participation does not create any expectation that the features, functionality, or design you experience during the Beta will be present in any future release of the Rouxbarb application.
3. Confidentiality
The Beta App, its features, design, and performance — and any information you learn about Rouxbarb through your participation — are confidential ("Confidential Information").
You agree not to:
(a) publicly post, publish, broadcast, stream, or otherwise disclose screenshots, screen recordings, descriptions of features, or any other Confidential Information without our prior written consent;
(b) discuss the Beta App's unreleased features on social media, review platforms, forums, or in press or media contexts; or
(c) share your TestFlight access or invite link with any third party.
Confidentiality obligations under this clause survive the end of your Beta participation for a period of 12 months.
4. Feedback and ownership
We encourage you to share bug reports, feature suggestions, and general observations ("Feedback") via the means we make available (in-app reporting, TestFlight feedback, or direct communication with our team).
You retain ownership of any original creative content you contribute to the platform during testing. However, any Feedback you provide to us — including bug reports, usability observations, feature ideas, and suggestions — is assigned to Rouxbarb ApS. We may use, reproduce, incorporate, and build upon your Feedback freely and without restriction, compensation, or attribution. You waive any moral rights in Feedback to the extent permitted by applicable law.
5. Your obligations as a tester
You agree to:
(a) use the Beta App honestly and in good faith, attempting to replicate realistic usage scenarios;
(b) report bugs, crashes, or unexpected behaviour through the available channels;
(c) use the Beta App only on a device and Apple ID that belong to you;
(d) comply with Apple's TestFlight terms and conditions, which apply independently of these Terms; and
(e) not use the Beta App for any unlawful purpose or in a manner that could harm Rouxbarb, other users, or third parties.
6. Data and privacy
Your participation involves the collection and processing of personal data as described in our Beta Privacy Notice. That notice explains what data we collect, why we collect it, how long we keep it, and your rights under the GDPR.
By participating in the Beta, you acknowledge that you have read and understood our Beta Privacy Notice.
You may withdraw from the Beta and request deletion of your data at any time by emailing privacy@rouxbarb.com. We will process your request within 30 days, including removal of your TestFlight access.
7. Limitation of liability
To the maximum extent permitted by applicable law, Rouxbarb ApS's total liability to you in connection with the Beta — for any cause whatsoever and regardless of the form of the action — shall not exceed EUR 100.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or any other intangible losses, arising from your participation in or inability to participate in the Beta.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable Danish or EU law.
8. Termination
We may end the Beta, or your individual access to it, at any time and for any reason without prior notice. You may withdraw from the Beta at any time by emailing support@rouxbarb.com.
On termination, clauses 3 (Confidentiality), 4 (Feedback and ownership), 7 (Limitation of liability), and 9 (Governing law) survive.
9. Governing law and disputes
These Terms are governed by the laws of Denmark. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark, without prejudice to your rights as a consumer under mandatory applicable law.
